Nothing in this document prevents either party from maintaining an absolute divorce action against the other party based on the statutory ground for separation; However, the rights and obligations arising from this agreement are beyond such a divorce, regardless of the person who obtained or is applying for such divorce. The parties also agree that this Agreement will not be included in a final divorce order by reference or otherwise, that this Agreement and the terms of this Agreement will not be made public, and that this Agreement will not be recorded on the Wake County Public Registry or on the public registry of any other district in that state. Separation agreements are documents that, once signed by both parties, are binding as contracts.
